Terms of Service

By creating a Thexly account or using the service, you agree to these terms. If you're using Thexly on behalf of a business or agency, you're confirming you have authority to bind that business to these terms.

Thexly is a web analytics service that connects your website traffic to real revenue from a connected payment processor, so you can see which channels actually produced paying customers rather than relying on ad platforms' self-reported numbers. Some figures Thexly shows, notably anything derived from Google Search Console, are directional, modeled estimates, not exact click-verified attribution, and are labeled as such in the product. Features, plan limits, and pricing are described on our pricing page and may change with notice.

You're responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately if you suspect unauthorized access. You must be legally able to enter a contract to sign up (i.e., not a minor).

You agree not to:

• Use Thexly for anything illegal, or in a way that violates someone else's rights
• Reverse-engineer, resell, or white-label the Thexly service itself (as distinct from sharing your own dashboard data with your own clients, which is an explicit, supported feature, see below)
• Attempt to bypass usage limits, security controls, or rate limits
• Submit government ID numbers, card numbers, health data, or other sensitive personal data into any Thexly field not specifically designed for it
• Use the service to track a website you don't own or don't have authorization to track

Thexly is explicitly built to let agencies connect and manage multiple client websites and payment accounts from one login, and to share a read-only, no-login dashboard link with each client. Using this feature, you confirm that:

• You have the right to connect each client's website, payment processor, and (if applicable) Search Console property
• You are responsible for your own relationship and agreement with your client regarding their data. Thexly is a processor of that data on your behalf (see the Data Processing Agreement), not a party to your client relationship
• Any share link you generate is your responsibility to distribute appropriately; Thexly enforces that it can't reach other clients' data or your account settings, but you control who you send the link to

You retain ownership of your website's analytics and revenue data. We don't sell it, and we don't use it to train generalized AI/ML models. You grant us the limited right to process it as needed to provide the service (see the Privacy Policy and Data Processing Agreement). If you delete your account, we delete your data per the retention schedule in the Privacy Policy.

Thexly retains all rights to the Thexly software, branding, and documentation, separate from your ownership of your own data under section 7. You may not copy, reverse-engineer, sublicense, or use Thexly's name or trademarks without written permission. Your account is for your own organization's use; don't share login credentials with people outside your team, and don't use one account to serve unrelated third parties beyond the agency-client sharing explicitly supported in section 6.

Thexly connects to services we don't control, payment processors you choose to connect (Stripe, Lemon Squeezy, Polar, Dodo Payments, Yolfi) and, if you connect it, Google Search Console. You can also import historical data from a Plausible or Umami export, or a previous Thexly backup file, during setup. Your use of any third-party service is governed by its own terms. We're not responsible for their availability, accuracy, or changes to their APIs, though we'll do our best to keep integrations working and to tell you when something breaks.

Thexly is provided "as is." We don't guarantee uninterrupted availability, and we don't guarantee that every payment will be perfectly attributed. Some payments will be unattributed for reasons explained in the product (see the Revenue Diagnostics feature), and Search-Console-derived figures are estimates, not exact measurements. Whether any uptime commitment applies will be confirmed here before this is final.

To the maximum extent permitted by law, Thexly won't be liable for indirect, incidental, or consequential damages (including lost profits or lost data), and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability where the law doesn't allow it to be limited (e.g. for our own gross negligence, where applicable under your jurisdiction).

You can stop using Thexly and cancel your subscription at any time. We can suspend or terminate your account for breach of these terms (including abuse, non-payment, or illegal use), with notice where reasonably possible. On termination, your data is deleted per the Privacy Policy's retention schedule.

Neither party is liable for a delay or failure to perform caused by something reasonably outside their control, for example, an internet or hosting outage, a natural disaster, or an outage or change at a third-party service Thexly depends on, like a payment processor or Google's APIs.

If a disagreement comes up, contact us first at the address below so we can try to resolve it informally. If that doesn't work, disputes are handled under the governing law and courts named in section 16.

We'll update the effective date above when these terms change, and notify account holders of material changes by email before they take effect.

These terms are governed by the laws of Ireland, and any dispute not resolved informally under section 14 is subject to the exclusive jurisdiction of the Irish courts. Thexly is operated by Thexly Limited, based in Limerick, Ireland.

These terms, together with the Privacy Policy and Data Processing Agreement, are the entire agreement between you and Thexly about the service. If any part of these terms turns out to be unenforceable, the rest stays in effect. We may assign these terms in connection with a merger, acquisition, or sale of the business; you may not assign your account without our consent. We'll send notices to the email address on your account.
